These Website Terms of Use (the “Terms”) govern access to and use of umushroomer.com, including its articles, mushroom directory, images, links, and other Website materials (collectively, the “Website”).
These Terms apply only to the Website. The uMushroomer mobile application is a separate service governed by its own terms and privacy policy.
References to “uMushroomer,” “we,” “us,” or “our” mean the operator of the Website. By accessing or using the Website after receiving reasonable notice of these Terms, you agree to them and to the Website Privacy Policy. If you do not agree, do not use the Website.
1. Critical mushroom-safety notice
The Website cannot determine whether a mushroom or plant is safe to touch, eat, cultivate, sell, serve, or administer to a person or animal. Never rely on the Website, a photograph, a species page, a comparison, or any other online source as the sole basis for such a decision.
Mushrooms can vary by age, location, environment, and condition. Edible and poisonous species may look alike, photographs may omit essential characteristics, and Website content may be incomplete, outdated, geographically inapplicable, or wrong. Cooking, drying, freezing, soaking, or other preparation does not reliably make an unknown mushroom safe.
The Website is provided for general informational and educational purposes. It does not provide medical, veterinary, toxicological, emergency, professional-mycology, food-safety, commercial, or legal advice and is not a substitute for an in-person assessment by a qualified local expert.
If a mushroom or plant may have been ingested or caused a reaction, contact local emergency services, a poison-control center, or a veterinarian immediately. Do not wait for symptoms or for a response from us.
To the fullest extent permitted by applicable law, you are responsible for decisions you make based on Website content and assume the risks associated with foraging, handling, ingestion, cultivation, sale, service, or administration of any mushroom or plant.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Website. If applicable law permits a person under 18 to browse the Website, that person may do so only with permission and supervision from a parent or legal guardian and must not use Website content to make foraging or consumption decisions.
If you use the Website on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
You may not use the Website if doing so would violate applicable law, sanctions, or export-control restrictions.
3. Limited permission to use the Website
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable permission to access and use the Website for lawful, non-commercial, informational purposes.
No rights are granted except those expressly stated in these Terms. We and our licensors reserve all other rights.
4. Acceptable use
You must not, and must not assist another person to:
- use the Website unlawfully, fraudulently, deceptively, or in a manner that infringes another person's rights;
- present Website content as a guarantee of safety, edibility, professional verification, or regulatory approval;
- use the Website to diagnose or treat a person or animal or to provide emergency advice;
- copy, republish, sell, rent, sublicense, distribute, commercially exploit, or create unauthorized derivative works from the Website or a substantial part of it;
- remove copyright, attribution, trademark, or other proprietary notices;
- interfere with, disrupt, overload, probe, scan, or test the vulnerability of the Website or related systems;
- bypass access, rate-limit, robot-exclusion, authentication, or security controls;
- introduce malware, harmful code, or deceptive links;
- scrape, crawl, harvest, index, download, or extract Website content by automated means except as permitted by applicable law, a public robots file, a search-engine convention we support, or our written authorization;
- reverse engineer, decompile, disassemble, or attempt to derive source code from Website software except where applicable law expressly permits it;
- use Website content to create, train, benchmark, evaluate, or improve a competing model, dataset, product, or service without written permission; or
- use the Website in a way that could expose the Website, its operator, users, or third parties to liability or harm.
We may investigate suspected violations and restrict access, preserve evidence, or cooperate with lawful authorities where reasonably appropriate.
5. Website content and mushroom information
The Website may contain articles, photographs, scientific and common names, taxonomic information, descriptions, edibility or toxicity classifications, habitats, seasonal information, comparison material, and links to sources or related pages.
Taxonomy, common names, scientific understanding, and safety guidance can change. Information applicable to one region, specimen, or species may not apply elsewhere. The absence of a warning does not mean a mushroom is safe, and a label such as “edible” is not advice or permission to consume a specimen.
You are responsible for independently checking information against current, authoritative local sources and consulting a qualified expert. Website content is not a certification, warranty, identification service, or authorization to consume, handle, cultivate, sell, serve, or administer a mushroom or plant.
We may correct, update, remove, or decline to update content at any time. We do not undertake a duty to monitor every scientific, taxonomic, regulatory, or safety development.
6. Ownership and intellectual property
The Website's software, interfaces, selection, arrangement, design, text, graphics, logos, databases, compilations, and other materials supplied by us or our licensors are protected by copyright, trademark, database-right, and other applicable laws.
Third-party photographs, names, quotations, and other materials remain the property of their respective owners and may be subject to separate licenses or attribution requirements. Their appearance on the Website does not imply endorsement, sponsorship, or affiliation.
You may link to a public Website page in a lawful and non-deceptive manner that does not suggest endorsement or affiliation. We may request removal of a link that is unlawful, misleading, harmful, or uses protected branding without permission.
If you believe material on the Website infringes your copyright or another intellectual-property right, email begeniustech@gmail.com with:
- identification of the protected work;
- the URL and description of the challenged material;
- your contact information;
- a statement explaining the basis of your claim;
- a good-faith statement that the challenged use is not authorized; and
- any declaration or signature required by applicable law.
We may remove or restrict material and may forward the notice to the person or source that supplied it.
7. Feedback and communications
If you voluntarily provide suggestions, corrections, ideas, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable right to use it without restriction or compensation. Do not send feedback you consider confidential.
Email and other communications do not create a professional, fiduciary, advisory, employment, partnership, joint-venture, or agency relationship. We do not guarantee that we will receive or respond to every message.
8. Third-party content, links, and services
The Website may retrieve public reference content from a hosted database and may link to third-party websites, sources, services, or the separate uMushroomer mobile application. Third-party material is provided for convenience and informational context.
We do not control and are not responsible for third-party availability, accuracy, legality, safety, security, products, privacy practices, or terms. A link, citation, integration, or attribution does not imply endorsement. Your use of third-party services is governed by their own terms and is at your own risk to the extent permitted by law.
9. Availability and changes
We may add, modify, restrict, suspend, or discontinue any part of the Website at any time. We do not guarantee that the Website or any content will remain available, current, complete, uninterrupted, secure, or error-free.
We may update these Terms for legal, security, operational, or Website-related reasons. Revised Terms will be posted with a new effective date. Where required, we will provide additional notice. Changes apply prospectively unless applicable law permits otherwise. If you do not agree to revised Terms, stop using the Website.
10. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND.
We disclaim all express, implied, and statutory warranties, including warranties of accuracy, completeness, reliability, timeliness, merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, quiet enjoyment, availability, and security.
We do not warrant that any mushroom identification, classification, image, description, link, or safety statement is correct or applicable to your specimen, circumstances, or location; that defects will be corrected; or that the Website is free of harmful components. No oral or written statement creates a warranty not expressly stated in these Terms.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UMUSHROOMER AND THE PERSONS AND SERVICE PROVIDERS INVOLVED IN OPERATING THE WEBSITE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR OPPORTUNITY; OR DAMAGES ARISING FROM RELIANCE ON MUSHROOM- OR PLANT-RELATED CONTENT, EVEN IF ADVISED THAT SUCH DAMAGE WAS POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SPECIFICALLY FOR USE OF THE WEBSITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100.
The limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not apply to liability that cannot lawfully be limited, which may include liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of mandatory consumer law, depending on your jurisdiction.
12. Indemnity
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless uMushroomer and the persons and service providers involved in operating the Website from claims, damages, losses, liabilities, judgments, penalties, costs, and reasonable legal fees arising from your unlawful or unauthorized use of the Website, violation of these Terms, misuse or republication of Website content, or infringement of another person's rights.
This section does not apply to the extent prohibited by mandatory consumer law. We may control the defense of a covered claim, and you agree to cooperate reasonably. You may not settle such a claim in a manner that admits fault by or imposes obligations on us without our written consent.
13. Disputes, governing law, and time to bring claims
Before filing a formal claim, you agree to send a written description of the dispute to begeniustech@gmail.com and allow 30 days for informal resolution. This requirement does not prevent either party from seeking urgent injunctive relief or using a consumer-protection process where advance notice cannot lawfully be required.
These Terms are governed by the laws applicable where the Website operator is established, without regard to conflict-of-law rules, except that mandatory consumer protections of your country of residence remain applicable. Courts with jurisdiction under applicable law will have jurisdiction over disputes.
To the fullest extent permitted by law, claims must be brought on an individual basis and not as a plaintiff or class member in a class, consolidated, collective, or representative proceeding. If this waiver is unenforceable in your jurisdiction, it does not apply.
To the fullest extent permitted by law, a claim arising from the Website or these Terms must be filed within one year after the claim arose. Any mandatory longer limitation period remains unaffected.
14. Electronic notices
You agree that we may provide Website-related agreements, notices, disclosures, and other communications electronically, including by email or by posting them on the Website. Electronic communications satisfy requirements that they be in writing to the extent permitted by law.
15. Miscellaneous
- Entire agreement. These Terms and the Website Privacy Policy form the entire agreement concerning use of the Website and supersede prior Website terms on the same subject.
- Severability. If a provision is unenforceable, it will be enforced to the maximum extent permitted or severed, and the remainder will remain effective.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, financing, sale of assets, transfer of the Website, or by operation of law, subject to applicable law.
- No third-party beneficiaries. Except where these Terms expressly state otherwise, they create no third-party beneficiary rights.
- Force majeure. We are not responsible for delay or failure caused by events beyond our reasonable control, subject to applicable law.
- Headings. Headings are for convenience only and do not affect interpretation.
- Language. The English version controls to the extent permitted by law. A translation is provided for convenience unless applicable law requires otherwise.
